Terms of Service

1. Acceptance and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and BBToolsFactory regarding your use of the "Tower Builder Stack" mobile application and its associated services. By downloading, installing, or playing the Game, you represent that you are of legal age to form a binding contract and that you have reviewed and accepted these Terms in their entirety.

If you are using the Services on behalf of a minor, you agree to be responsible for their compliance with these Terms. If you do not agree to these Terms, you must immediately cease all use of the Game and delete the application from your device. We may update these Terms from time to time, and your continued use of the Game constitutes acceptance of those changes.

2. License Grant and Restrictions

Subject to your strict compliance with these Terms, BBToolsFactory grants you a limited, non-exclusive, non-transferable, revocable license to download and play Tower Builder Stack for your personal, non-commercial entertainment purposes. This license does not include any rights to:

• Modify, reverse engineer, decompile, or attempt to extract the source code of the Game.
• Use the Game for any commercial purposes, including competitive play for prizes without our explicit consent.
• Distribute or sublicense the Game through unauthorized channels or third-party app stores.
• Utilize any automation scripts, bots, or hacks to manipulate high scores or gameplay physics.

Any violation of these restrictions will result in the immediate revocation of your license and may subject you to legal liability.

3. In-Game Purchases and Virtual Items

Tower Builder Stack may offer virtual items or currency (such as unique block themes or ad-removal tokens) for purchase through the App Store or Google Play Store. You acknowledge that:

• Virtual items have no real-world monetary value and cannot be exchanged for "real" money or property.
• All purchases are final and non-refundable, except as required by law or the policies of the respective app store provider (Apple or Google).
• We reserve the right to manage, regulate, and modify the availability and "price" of virtual items at any time without notice.

4. User Conduct and Fair Play

We pride ourselves on providing a fair and competitive environment for all builders. You agree to use the Game in a manner that is respectful and lawful. Prohibited conduct includes, but is not limited to:

• Harassing or bullying other players through leaderboard usernames or connected social features.
• Exploiting bugs or glitches to gain an unfair advantage in tower height.
• Impersonating BBToolsFactory employees or other authorized representatives.
• Uploading or sharing any content that is defamatory, obscene, or infringing upon third-party rights.

We reserve the right to ban accounts or reset scores of users found in violation of our fair play standards.

5. Ownership and Intellectual Property

All title, ownership rights, and intellectual property rights in and to the Game (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, dialogue, catchphrases, locations, concepts, artwork, structural designs, animations, sounds, musical compositions, audio-visual effects, and methods of operation) are owned by BBToolsFactory.

The "Tower Builder Stack" logo and its associated brand marks are trademarks of BBToolsFactory. You may not use our trademarks or copyrighted materials for any purpose without our prior written authorization.

6. Termination

These Terms are effective until terminated by either you or us. You may terminate these Terms by deleting the Game and all copies thereof from your device. We may terminate these Terms immediately and without notice if you fail to comply with any provision of these Terms. Upon termination, all licenses granted to you shall immediately cease, and you must destroy all copies of the Game in your possession.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. BBToolsFactory DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE.

8. Limitation of Liability

IN NO EVENT SHALL BBToolsFactory BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE GAME, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY.

9. Indemnification

You agree to indemnify, defend, and hold harmless BBToolsFactory and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Game or your violation of these Terms.

10. Governing Law and Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.
